Event puts property matters under the magnifying glass
From My Home attended Snyman de Jager Attorneys' yearly legal update, which took place in Tshwane (Pretoria) on June 13, 2023.
Johan Muller, a legal expert at Snyman de Jager Attorneys, discussed various topics relevant to the real estate industry.
One particular aspect Muller discussed in great detail was what steps need to be followed once a legal possession turns unlawful.
For instance, when a tenant who has signed a rental contract suddenly refuses to pay rent, does not comply with legal demands and will not vacate the said property.
Muller advised Property Professionals, and therefore homeowners alike, to act "instantly" and get a spoliation order for trespassing immediately.
"Once a tenant stops paying his/her rent, he/she is in breach and contracts are there to be enforced," he explains.
"If you have followed the correct legal procedures and the tenant still does not comply, lay a complaint of trespassing as soon as possible since legal possession has now turned into trespassing, which is a criminal offence."
He also advised that a homeowner should never leave a property derelict.
"Take care of your investment by asking a neighbour to keep a watchful eye and report anything suspect to you."
Another option is to make use of armed response organisations when a property stands vacant for an extended period.
